1. Acceptance of Terms

By accessing our website, contacting us, or using the charter services of Fiama Luxury Club ("Fiama," "we," "our," or "us"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

These terms govern the relationship between Fiama Luxury Club and any individual or entity ("Client," "you," "your") who engages our yacht charter services in Sardinia, Italy.

2. Services Description

Fiama Luxury Club provides luxury yacht charter services aboard the Bavaria SR41 in the waters of Sardinia, including the Arcipelago di La Maddalena, Costa Smeralda, and surrounding areas. Our services include:

• Full-day and half-day yacht charter experiences
• Professional skipper and crew services
• Curated onboard catering, beverages, and champagne service
• Wellness and lifestyle experiences (Fiama Cosmesi)
• Private events and corporate experiences at sea
• The Circle influencer program

3. Bookings and Reservations

Reservation Process

All bookings must be made directly through Fiama Luxury Club via WhatsApp, email, or our official website contact channels. A booking is confirmed only upon receipt of a written confirmation from us and payment of the required deposit.

Deposit and Payment

• A deposit of 30% of the total charter fee is required to confirm a reservation
• The remaining balance is due 14 days prior to the charter date
• For bookings made within 14 days of the charter date, full payment is required at the time of booking
• Payment is accepted via bank transfer, credit card, or other agreed methods

Pricing

All prices are quoted in euros (€) and are inclusive of crew, fuel for standard itineraries, and basic onboard provisions unless otherwise stated. Additional services (premium catering, special activities, extended routes) are quoted separately.

4. Cancellation Policy

Cancellation by Client

• More than 30 days before departure: Full refund of deposit
• 15–30 days before departure: 50% of deposit is non-refundable
• 7–14 days before departure: Full deposit is non-refundable
• Less than 7 days before departure: 100% of total charter fee is non-refundable

Cancellation by Fiama Luxury Club

In the event we must cancel due to circumstances within our control, we will offer a full refund or reschedule at no additional cost. We are not liable for cancellations due to adverse weather conditions, force majeure, port authority restrictions, or other circumstances beyond our reasonable control. In such cases, we will endeavor to reschedule at the earliest opportunity.

5. Weather and Safety

The safety of our guests and crew is our highest priority. Our professional skipper has sole and absolute discretion to modify, postpone, or cancel any charter itinerary due to weather conditions, sea state, or safety concerns. Such decisions are final and not subject to negotiation.

In the event of weather cancellation, we will offer:

• A rescheduled date at no additional cost (subject to availability), or
• A refund or credit note at our discretion

Minor itinerary changes due to weather or sea conditions do not constitute grounds for a refund.

6. Client Responsibilities and Conduct

All Clients and their guests are expected to:

• Treat crew members with respect and courtesy at all times
• Follow all safety instructions provided by the skipper and crew
• Refrain from behavior that endangers others on board
• Report any health conditions, allergies, or special needs prior to embarkation
• Not consume illegal substances on board
• Respect the marine environment and comply with Italian maritime regulations

Fiama Luxury Club reserves the right to terminate a charter immediately, without refund, if any guest behaves in a manner deemed unsafe, disrespectful, or in violation of these terms.

Minimum Age

Children under 12 must wear life jackets at all times while on deck. Parents or legal guardians are fully responsible for the safety of minors in their care. All guests under 18 must be accompanied by a responsible adult.

7. Liability and Insurance

The Bavaria SR41 is fully insured in accordance with Italian maritime regulations. Our liability to Clients is limited to the value of the charter fee paid. We are not responsible for:

• Personal injury resulting from a Client's failure to follow safety instructions
• Loss, theft, or damage to personal belongings
• Indirect, consequential, or special damages of any kind
• Loss of enjoyment due to weather or circumstances beyond our control

We strongly recommend that all guests obtain comprehensive travel and personal insurance prior to their charter.

8. Health and Accessibility

Guests with medical conditions, limited mobility, or special requirements must inform us at the time of booking. While we will make every effort to accommodate your needs, the nature of maritime activities imposes certain physical limitations. We reserve the right to refuse embarkation to any person whose health condition may pose a risk to themselves or others on board.

Fiama Luxury Club is not liable for any health-related incidents resulting from undisclosed medical conditions.

9. Intellectual Property

All content on our website, including text, photographs, graphics, logos, and the Fiama Luxury Club brand identity, is the exclusive property of Fiama Luxury Club and is protected by applicable intellectual property laws.

Photographs taken during your charter experience may be shared publicly only with prior written consent from Fiama Luxury Club. Images featuring our crew, yacht, or branded items for commercial purposes require explicit written authorization.

10. The Circle — Influencer Program

Participation in The Circle influencer program is by invitation or application and is subject to separate program terms communicated at the time of onboarding. Commission structures, access levels, and benefits are outlined in individual program agreements. Fiama Luxury Club reserves the right to modify, suspend, or terminate The Circle program at any time with reasonable notice to active members.

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Italian Republic. Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of Olbia (Sassari), Sardinia, Italy.

For Clients resident within the European Union, mandatory consumer protection laws of your country of residence may also apply and are not affected by this clause.

12. Dispute Resolution

In the event of a dispute, we encourage Clients to first contact us directly to seek an amicable resolution. We are committed to addressing concerns promptly and fairly. If an informal resolution is not reached, disputes may be submitted to mediation before resorting to litigation.

13. Amendments

Fiama Luxury Club reserves the right to update these Terms and Conditions at any time. Changes will be posted on our website with a revised effective date. Continued use of our services following any modification constitutes your acceptance of the updated terms.
